These Terms and Conditions (“Terms”) govern your use of the Hummingbird Humanity website at hummingbirdhumanity.com (the “Site”) and any services booked through us, including consulting, workshops, training, leadership development, and speaking engagements. By using the Site or engaging our services, you agree to these Terms. If you do not agree, please do not use the Site or our services.
1. Who We Are
Hummingbird Humanity (“Hummingbird Humanity,” “we,” “us,” or “our”) partners with organizations to build human-centered workplace cultures where representation matters, diverse voices are celebrated, and everyone knows they belong. Our offerings include consulting (such as the DEI DNA Assessment, Diversity Learning Circles, and Strategic Roadmapping), Hummingbird Speaks, Hummingbird Books, our newsletter, and the Environmental Impact Calculator.
2. Use of the Site
You may use the Site for lawful purposes only. You agree not to misuse the Site, attempt to gain unauthorized access to it, interfere with its operation, or use it in a way that is harassing, discriminatory, or harmful to others. We may restrict or end access to the Site at any time if these Terms are breached.
3. Intellectual Property
All content on the Site, including text, graphics, logos, books, and materials developed for workshops or consulting engagements, is the property of Hummingbird Humanity unless otherwise noted. 4. Service Engagements
Consulting projects, workshops, training sessions, and speaking bookings are governed by the specific proposal, statement of work, or agreement provided at the time of booking. If these Terms conflict with a signed agreement for a specific engagement, the signed agreement takes precedence.
5. Fees, Payment, and Cancellation
Fees, payment schedules, and cancellation policies are set out in each client agreement. Unless that agreement says otherwise, deposits are non-refundable and full payment is due according to the agreed schedule.
6. Books and Purchases
If you buy books or other products through the Site or a partner retailer, the price, availability, and shipping or delivery terms shown at checkout apply. Payments are handled by a third-party payment processor. Our books are for educational use and may not be copied or resold in bulk without our written permission.
7. Newsletter
By subscribing to the Hummingbird Newsletter, you agree to receive emails about events, resources, and workplace culture topics. You can unsubscribe at any time using the link in any email.
8. Environmental Impact Calculator
The Environmental Impact Calculator provides illustrative estimates based on published conversion factors and average-use data. Results are not an audited greenhouse-gas inventory, a certified lifecycle assessment, a utility bill, or financial, regulatory, or scientific advice. Your entries stay in your browser, as described in our Privacy Policy.
9. No Guarantee of Outcomes and No Professional Advice
We provide consulting, training, and educational services in good faith and based on professional expertise. We do not guarantee specific business outcomes. Nothing in our services or on the Site constitutes legal, financial, or HR compliance advice. Clients remain responsible for their own organizational decisions and for compliance with applicable laws.
10. Limitation of Liability
To the fullest extent permitted by law, Hummingbird Humanity is not liable for indirect, incidental, or consequential damages arising from the use of our services or the Site. The Site and its content are provided “as is,” without warranties of any kind.
